West Wind Fine Art LLC is in the business of selling art, books, and instructional art DVDs. Our annual sales exceed $10,000.

On an ongoing basis our company anticipates receiving the following personal information from the European Union: Through our online registration forms, our company will collect names, mailing addresses including country, e-mail addresses, and credit card information from visitors to our web site. No additional information about the user's visit to the West Wind Fine Art web site--or any other participating sites--is ever stored or sold. For each user to the company's web site, the company web server automatically recognizes the following: the host origin of the request (the user's IP address), the referrer (where the user came from), the requested document (the page user is looking at), the user's browser type, and the user's platform-dependent information (e.g., Win '98). None of this information is stored on any individual who does not request that their name, address, and or e-mail address be added to West Wind Fine Art's mailing list.

West Wind Fine Art, LLC privacy policy includes the following provisions:
   The effective date of implementation is May 2009.
   The F.T.C. is the agency that has jurisdiction to hear any claims against the company regarding possible unfair or deceptive practices and violations of laws or regulations governing privacy.
   West Wind fine Art, LLC does not belong to any privacy programs.
   The method of verification used to insure privacy protection compliance is in-house audit.

The E.U. Data Protection Authority is an independent recourse mechanism that is available to users to help them investigate and resolve complaints.

Our company is committed to cooperate with the E.U. Data Protection Authorities or other authorities concerned and will: (a) provide recourse for individuals to whom the data relate, (b) provide follow up procedures for verifying that the attestations and assertions made by our company about its privacy practices are true, and (c) provide remedies for problems arising out of failure to comply with the Principles and consequences.

Our company recognizes its obligations to provide an annual assessment of its compliance with the Data Privacy Authorities' standards.

Our company adheres to the U.S. Commerce Department Safe Harbor Principles and recognizes that its undertaking to adhere to the Safe Harbor Principles is not time-limited in respect of data received during the period in which the company enjoys the benefits of the safe harbor. By this undertaking our company asserts that it will continue to apply the Safe Harbor Principles to such data for as long as the company stores, uses or discloses them, even if it subsequently leaves the Safe Harbor for any reason.

Our company agrees to follow the Safe Harbor Principles with respect to all personal information received from the E.U. after it joins the safe harbor.

Our company recognizes that any misrepresentation to the general public concerning a company's adherence to the Safe Harbor Principles may be actionable
by the Federal Trade Commission or other relevant government body. Misrepresentations to the Department of Commerce (or its designee)
may be actionable under the False Statements Act (18 U.S.C. ยง 1001).
